SECTION 1: CUSTOM ORDERS (CAKES)
These terms apply specifically to orders for custom cakes and other products requiring special preparation and local pickup.
1.1. Deposit A 50% non-refundable deposit is required to reserve your date. No order will be processed or prepared until the deposit has been received. By paying, you confirm that all information on the invoice is correct. The deposit constitutes liquidated damages in the event of a breach and is not a penalty.
1.2. Final Payment The remaining balance must be paid two (2) days before delivery/pickup. Your order will not be delivered if the final payment is not received by the stipulated date, which will result in the cancellation of the order.
1.3. Cancellations and Postponements
- More than 7 days in advance: A credit will be issued for future use.
- Within 7 days of the event date: No credit will be issued, and the full balance of the order will be due.
1.4. Order Changes Design changes are accepted up to seven (7) days before the scheduled date. Any changes requested after this date cannot be guaranteed and may be subject to additional charges.
1.5. Pickup and Delivery (Clearwater, FL)
- Responsibility: If you or your representative choose to pick up the order, you assume all responsibility for its condition once it has left our possession. The Cakery Dani LLC is not responsible for any damage due to improper handling (including collapse, melting, etc.) once your order has been picked up or delivered.
- Proper Environment: You are responsible for providing a safe environment for your cake (away from heat, direct sunlight, vibrations). Cakes must be stored at an optimal room temperature of 70°F (21°C) or less and require a stable, sturdy surface.
- Times and Address: The pickup location is in Clearwater, FL. The precise address will be provided upon booking. Weekend pickups are generally scheduled between 10:00 am and 12:00 pm. Please be punctual for your scheduled time.
- Late Pickup Fees: Fees for lateness will apply and must be paid before the order is handed over.
- $15 for a 30-minute delay.
- $40 for a 60-minute delay.
SECTION 2: SHIPPED PRODUCTS (COOKIES)
These terms apply to cookies and other products available for nationwide shipping.
2.1. Payment 100% payment of the order is required upfront. Your order will not be processed until full payment has been received.
2.2. Shipping Policy To ensure maximum freshness and prevent products from being held in warehouses over the weekend, we operate on a fixed shipping schedule.
- Shipping Day: We ship all orders only on Mondays.
- Weekly Order Cutoff: The cutoff for Monday shipping is Saturday at 11:59 PM.
- Orders After Cutoff: Orders placed after Saturday at 11:59 PM (including Sunday) will be processed and shipped the following Monday.
2.3. Cancellations and Changes You may cancel or request changes to your order before the weekly cutoff (Saturday at 11:59 PM). Once the cutoff has passed, the order enters production, and no cancellations or modifications will be accepted.
2.4. Liability During Shipping Once your order is handed over to the carrier, The Cakery Dani LLC is not responsible for delays, damage, or lost packages during transit.
SECTION 3: GENERAL TERMS (ALL PRODUCTS)
3.1. Product Quality Our products are perishable and delicate. We provide care instructions to ensure their quality, freshness, and design. We are not responsible for damage caused by failure to follow said instructions.
3.2. Allergies Our products are prepared in a kitchen where soy, eggs, gluten, dairy, tree nuts, and other allergens may be present. Although we take precautions to avoid cross-contamination, we cannot guarantee that products are allergen-free. It is your responsibility to notify your guests. The Cakery Dani LLC disclaims all liability for allergic reactions.
3.3. Emergencies and Force Majeure We shall not be liable for non-performance due to causes beyond our reasonable control (acts of God, pandemics, natural disasters, etc.). If we are unable to deliver your order for any of these reasons, you will be issued a full refund.
3.4. Claims Policy If you are not satisfied with your order, you must contact us on the same day of pickup or delivery receipt and provide detailed photographs of the issue. We will review the case to determine if you are eligible for a credit or refund, although one is not guaranteed.
